Terms and Conditions

Fitbit Pay allows you and additional cardholders to make payment transactions using a Hume Bank Visa Debit or Credit Card loaded onto a compatible Fitbit device at participating merchants. Fitbit Pay provides you with an additional way to transact on your linked account.

Hume Bank Fitbit Pay™ Terms and Conditions apply each time a Hume Bank card registered on Fitbit Pay is used.

1. Agreement to these Terms and Conditions

You agree that you accept these Terms and Conditions by adding your card to Fitbit Pay.

These Terms and Conditions apply in addition to:

2. Fitbit Pay is provided by Google

Fitbit Pay is provided by Google, not by Hume Bank. Hume Bank is not liable for the use, functionality or availability of Fitbit Pay, any Fitbit Device or any disruption caused from the availability of contactless merchant terminals or reduced service levels caused by the failure of telecommunications networks. You must agree to Fitbit’s terms and conditions in order to register and use Fitbit Pay.

3. Using your Hume Bank Card with Fitbit Pay

Your card can be registered with Fitbit Pay to make contactless payments at participating retailers. To add your card, you must follow the procedures provided by Hume Bank. In doing so, we may require you to adequately identify yourself via a variety of mechanisms to authenticate your request to register your card with Fitbit Pay. If we cannot authenticate your request to our satisfaction or if we suspect that there may be attempted fraud, we may decline the request to add your card to Fitbit Pay. Once your card is registered with Fitbit Pay, you can use your Fitbit Device and its security settings (such as passcode or biometric data) to authorise transactions on your account. You need to select your card as the default card in your Digital Wallet to ensure your card is used to complete a transaction. The transaction limits that apply to your card do not change as a result of adding it to Fitbit Pay. Fitbit Pay may not be accepted outside of Australia, or at all places where your Hume Bank Card is accepted. Suspension or Termination of Fitbit Pay Hume Bank may suspend or terminate your use of Fitbit Pay if:

  • your card is cancelled, blocked or suspended;
  • you breach these Terms and Conditions, or the Terms and Conditions listed under Clause 1.
  • we, Fitbit or a card network provider reasonably suspects fraud;
  • if we are required to do so under any legislation or law, or if required to by a regulatory or government body;
  • if our arrangements with Fitbit regarding Fitbit Pay cease or are suspended; and
  • for any other reason we deem appropriate.

You must tell us straight away if:

  • your card or Fitbit device has been lost or stolen; or
  • you suspect someone else has used your account without your permission or may have access to your Fitbit device or know your security credentials.

You must immediately unlink your card from Fitbit Pay if your Fitbit device is stolen or lost.

It may be possible to make transactions using Fitbit Pay after deleting or uninstalling the Fitbit application on your mobile device. If you no longer wish to use a Hume Bank Card with Fitbit Pay, you should remove your card from Fitbit Pay prior to deleting/uninstalling the Fitbit application on your mobile device.

You can ensure that your Hume Bank Card cannot be used with Fitbit Pay on your Fitbit device by:

  • removing the Fitbit account to which the Hume Bank Card was added on the Fitbit device;
  • undertaking a factory reset of your Fitbit Device; or
  • erasing your Fitbit device on the Fitbit mobile application.

If you fail to comply with any of the requirements stated in this clause, you are taken to have authorised any transaction made using Fitbit Pay on your Fitbit device and as such, the transaction cannot be deemed as an unauthorised transaction.

If your Hume Bank Visa Card registered with Fitbit Pay is lost or stolen, you will still be able to transact using Fitbit Pay while you wait for your new card. If you wish to stop transactions using Fitbit Pay (e.g. when your Fitbit Device is also lost or stolen) you must notify Hume Bank so that Hume Bank can remove the Hume Bank Visa Card from active status in Fitbit Pay. A Hume Bank Visa Card loaded in your Fitbit Pay that has a lost or stolen status will be automatically updated to the new card number once it has been activated.

5. Data Collection and Privacy

You agree that we may exchange information with Fitbit and card scheme networks (i.e. Visa), related to the set up and use of Fitbit Pay. By using Fitbit Pay you agree that:

  • Fitbit can provide us with information, such as your Fitbit device details, for purposes including providing customer support, detecting and managing fraud, and to comply with applicable laws and regulations.
  • We can provide Fitbit and card scheme networks with information for the purpose of generally improving Fitbit Pay. Each party’s data collection and handling practices are in accordance with their respective privacy policy (available at fitbit.com/global/us/legal/privacy-policy, visa.com.au)

Hume Bank’s privacy policy (available at humebank.com.au/privacy-policy/) provides further details regarding the collection and handling of your information.

We are not liable for any losses you may incur, injury or harm you may suffer as a result of Fitbit or a card scheme network’s use of your information. Should you not want to share this information, do not register your Hume Bank card in a digital wallet.

6. Hume Bank’s Liability

Hume Bank will not be liable for any loss arising from your use of Fitbit Pay to the extent the loss was caused by:

  • Your fraud;
  • Your failure to adequately secure your device, or protect any passcode used to access your device;
  • Your use of Fitbit Pay or the Fitbit device in a manner not permitted by Fitbit (for example, by obtaining root access to your Fitbit device); or
  • Subject to your rights under the ePayments Code, a reduced level of service caused by matters beyond our reasonable control (for example, those caused by third party software and network providers).

If you fail to comply with any of the requirements stated in this clause, you are taken to have authorised any transaction made using Fitbit Pay on your Fitbit device and the transaction cannot be deemed as an unauthorised transaction.
